These Terms of Service govern your use of wyfimarketing.com and any services provided by Wyfi Marketing ("we," "us," or "our"), based in Cambridge, MN. By accessing our website or engaging our services, you agree to these terms.
Wyfi Marketing provides web design, branding, digital marketing, photography, and related services to businesses. Specific deliverables, timelines, and pricing for each project are outlined in individual project agreements or proposals provided before work begins.
All projects begin with a written proposal or agreement outlining scope, timeline, and payment terms. Work does not begin until a deposit is received and the proposal is accepted. Any changes to project scope after acceptance may result in additional charges and timeline adjustments.
Payment terms are specified in each project proposal. Generally:
Clients are responsible for:
Upon receipt of final payment, clients receive full ownership of custom design work and website content created specifically for their project. Wyfi Marketing retains the right to display completed work in our portfolio and marketing materials unless the client requests otherwise in writing.
We retain ownership of any proprietary tools, frameworks, processes, or code libraries used in the development process that are not specific to the client's project.
If Wyfi Marketing provides hosting or maintenance services, these are provided on a month-to-month basis unless otherwise specified. Either party may terminate hosting or maintenance services with 30 days written notice. Upon termination, we will provide a backup of the website files.
Many of our services involve third-party platforms including Google Ads, Meta Ads, WordPress, and others. We are not responsible for changes, outages, or policy updates made by these third-party platforms that affect your project or campaigns.
For paid advertising management:
Wyfi Marketing's liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages including lost profits or business opportunities.
While we work hard to deliver quality results, we cannot guarantee specific outcomes such as search engine rankings, website traffic, leads, or revenue. SEO and digital marketing results depend on many factors including competition, market conditions, and algorithm changes outside our control.
We treat all client business information as confidential and do not share it with third parties except as required to deliver our services or comply with legal obligations.
Either party may terminate a project or ongoing service engagement with written notice. Clients are responsible for payment of all work completed up to the termination date. Deposits are non-refundable once work has begun.
These Terms are governed by the laws of the State of Minnesota. Any disputes arising from these terms or our services will be resolved in the courts of Isanti County, Minnesota.
We may update these Terms of Service from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
